Privacy Policy

This policy covers two groups of people: the firms that subscribe to ClerkBird, and the callers those firms' phone lines receive.

Information about subscribing firms

We collect the account owner's name and email address, the firm's name, timezone, practice areas, office hours and notification settings, and billing contact details processed by Paddle.

We use this to operate the service, to send transactional email, and to bill you. We do not sell it and we do not use it for advertising.

Information about callers

When ClerkBird answers a call on a firm's behalf it processes the caller's phone number, the audio of the call, a transcript, and whatever the caller chooses to say — which may include names, contact details, dates, and a description of their situation.

This information belongs to the firm. We process it on the firm's instruction, as its service provider. If you are a caller and want your information removed, contact the firm you called; we will assist them in fulfilling that request.

Recording disclosure

Every caller is told at the start of the call that they are speaking with an AI assistant and that the call is recorded. This happens before any information is collected.

Retention

Recordings are kept for the period the firm sets — commonly ninety days — and are then deleted automatically. Firms may choose to store no audio at all, in which case only the transcript is retained.

After a subscription ends, call data is retained for thirty days so the firm can export it, and is then deleted.

Security

Data is encrypted in transit and at rest. Recordings are served only through short-lived signed links and are never publicly addressable. Access to firm data in our systems is logged.

What we do not claim

ClerkBird does not establish or preserve attorney-client privilege, and you should not rely on it to do so.

ClerkBird is not HIPAA-certified and we do not sign business associate agreements. Personal injury calls can contain health information; handle that accordingly.

California residents

If you are a California resident you have the right to know what personal information is held about you, to request its deletion, and not to be discriminated against for exercising those rights. Requests about call data go to the firm you called; requests about account data can be sent to us directly.

Subprocessors

We use a small number of vendors to deliver the service. They are listed, with what each receives, on our subprocessors page.

This page describes how ClerkBird works and is not legal advice. Laws on call recording, AI disclosure and the unauthorized practice of law vary by state and change. Have your own counsel review how you use ClerkBird in the jurisdictions where you practise.
