Terms of Service

These terms govern your use of ClerkBird. By starting a trial or a subscription you agree to them.

What ClerkBird is

ClerkBird is software that answers telephone calls on your behalf, collects information from callers, and — where you enable it — schedules appointments on your calendar.

ClerkBird is not a telecommunications provider and does not resell telecommunications. It does not sell phone numbers, calling minutes or calling plans, and it cannot place outbound calls. Connectivity is supplied by the licensed providers listed on our subprocessors page and is used only to deliver the software service.

ClerkBird is not a law firm and does not provide legal services. It is a clerical tool operated by you, for your firm. You remain responsible for the professional obligations that attach to your practice, including competence, confidentiality, conflicts of interest and supervision.

Your responsibilities

You confirm that you are authorised to direct calls to ClerkBird for the numbers you connect, and that doing so is consistent with your professional and ethical obligations.

You are responsible for reviewing the intake questions and screening rules configured for your firm and for the consequences of the rules you set. A screening rule that declines a caller is your rule, applied on your instruction.

You are responsible for following up on leads and messages. ClerkBird records and notifies; it does not act on your behalf beyond the call.

Call recording and disclosure

ClerkBird states at the beginning of every call that the caller is speaking with an AI assistant and that the call is recorded. This behaviour cannot be disabled and is a condition of use.

You may set the retention period for recordings, including storing no audio at all. Transcripts are retained for the life of the account unless you request deletion.

Fees, trials and cancellation

Plans are billed monthly or annually in advance through Paddle, which acts as merchant of record. Each plan includes a monthly conversation-time allowance; time beyond that allowance is billed at the published rate.

Trials require a valid payment method and convert to a paid subscription at the end of the trial period unless cancelled.

You may cancel at any time in the dashboard. Service continues to the end of the period you have paid for. Phone numbers are released at the end of that period.

Service availability

We aim to keep ClerkBird answering at all times but do not promise uninterrupted service. Telephone delivery, speech processing and calendar integrations depend on third parties listed on our subprocessors page.

If a payment fails, service continues for seven days while you update your payment method before the agent is paused. We will email you first.

Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the fees you paid in the twelve months preceding the claim.

We are not liable for lost business, lost clients, lost profits, or for the content of any call.

Changes

We may update these terms. Material changes will be emailed to the account owner at least thirty days before they take effect.

This page describes how ClerkBird works and is not legal advice. Laws on call recording, AI disclosure and the unauthorized practice of law vary by state and change. Have your own counsel review how you use ClerkBird in the jurisdictions where you practise.
